These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and BookSpa AI ("BookSpa," "we," "us," or "our") governing your access to and use of the BookSpa platform, website, dashboard, and AI receptionist services.
By creating an account, starting a free trial, or using any part of our service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.
If you are using BookSpa on behalf of a business, you represent that you have authority to bind that business to these Terms.
BookSpa provides an AI-powered phone receptionist platform designed for medical spas and aesthetic practices. Our services include:
We reserve the right to modify, suspend, or discontinue any feature of our service at any time with reasonable notice to active subscribers.
To use BookSpa, you must create an account with accurate, complete, and current information. You are responsible for:
You may not share your account with others, create accounts using false information, or create multiple accounts to circumvent plan limitations or suspensions.
BookSpa offers the following subscription plans:
All subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Overage: If you exceed your plan's monthly minutes, additional usage is billed at $0.08 per minute and charged at the end of your billing cycle.
Cancellation: You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused time.
Refunds: We do not offer refunds except where required by applicable law or at our sole discretion in exceptional circumstances.
Payments are processed securely by Stripe. We do not store your payment card information.
New customers receive a 7-day free trial with access to all features of the Studio plan. The trial includes 20 complimentary minutes of AI call handling.
You agree to use BookSpa only for lawful purposes and in accordance with these Terms. You must not use our service to:

BookSpa's AI receptionist Sage is powered by large language models and voice AI technology. While we work hard to ensure accuracy, you acknowledge and agree that:
BookSpa may record and transcribe calls handled by Sage. Call recording laws vary significantly by jurisdiction. You are solely responsible for:
BookSpa is not liable for your failure to comply with call recording laws. By using our service, you indemnify us against any claims arising from recording compliance issues.
BookSpa is designed for aesthetic and cosmetic services, not for the treatment of medical conditions. Our standard service is not HIPAA-compliant.
Our property: BookSpa, Sage, and all related software, designs, text, and technology are owned by BookSpa AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Your property: You retain ownership of all data you upload or input into BookSpa, including your spa's services, pricing, and business information. By using our service, you grant us a limited license to use your data solely to provide the service to you.
Feedback: If you provide feedback or suggestions about our service, we may use them to improve BookSpa without any obligation to you.
To the maximum extent permitted by law, BookSpa's total liability to you for any claims arising from these Terms or your use of our service shall not exceed the amount you paid to us in the 3 months preceding the claim.

By you: You may cancel your account at any time from your dashboard. Upon cancellation your account remains active until the end of your paid period, then all services cease.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Before filing any legal claim, you agree to contact us at info@bookspaai.com and give us 30 days to resolve the issue informally.
If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You waive the right to participate in class action lawsuits against BookSpa.
We may update these Terms from time to time. When we make material changes we will notify you by email and display a notice in your dashboard at least 14 days before changes take effect.
Your continued use of BookSpa after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your account before the changes take effect.
